These Terms of Service govern all users (Employers and Job seekers) that access and use the contents and services provided by Peza Job website. The Peza Job website and its services herein called “platform”

By using our platform, you acknowledge that you have read and understood these Terms of Service and our Privacy Policy and agree to be bound by them. If you do not wish to be bound and abide by these Terms of Service or our Privacy Policy, you should not continue to access or use the Platform.

Peza Job may amend, add to, delete or revise the Terms of Service and our Privacy Policy at any time without prior notice. It is your responsibility to periodically review these Terms of Service and our Privacy Policy.

Use of our Platform

1. The user (Employer and Job seeker) agrees and expressly states that he/she is solely responsible for the accuracy and completeness of the Registration Data and other information given to Peza Job in the registration for membership in order to use the platform. The Member will ensure that the data shared with Peza Job Zambia doesn't contain any fraudulent, false, misleading or manipulated facts.

2. Browsing through Job seeker profile on our database of registered jobseekers can only be used for recruitment purposes. Using this service for the purposes of marketing or direct selling to Jobseekers is prohibited. All database rights and other applicable copyright and intellectual property rights belong to Peza Job.

3. You shall only use our Platform for the intended purpose of job application, job posting, jobseeker selection and career coaching. You shall not post, publish, transmit, store, distribute or circulate anything that:

• Violates any law or regulation;
• Infringes any copyright, trademark, trade secret or other intellectual property rights or proprietary rights of others or violate the privacy, publicity or personal rights of others;
• Causes any discriminatory, political, religious or security unrest;
• Is harmful, discriminatory, defamatory, threatening, harassing, intimidating, obscene, abusive, hateful, racists, blasphemous, false, illegal, improper or otherwise offensive or objectionable; and
• Contains viruses, trojan horses, worms, corrupted files or other materials or programs that may interrupt, disrupt, damage or limit the functionality and operation of the platform.

4. You further agree not to infringe or violate Peza Job’ rights and therefore shall not:

• Print, download, duplicate, transmit or otherwise copy, reproduce, redistribute, republish or use any Personal Data (as defined in the Privacy Policy) of any other Platform user for any other personal or commercial purposes other than for the purposes of job application or recruitment through our Platform;
• Delete, revise, remove, screen scrape, data mine, deploy robots or similar gathering/extraction tools on the Platform in any way;
• Send unsolicited messages and emails, hack, violate or attempt to circumvent the Platform security systems in place, which shall include accessing data not intended for you or logging into a server or user account without authorisation from us, probing, scanning or testing the vulnerability of our system and networks in anyway breaching our Platform security and authentication measures.

Violation of our Platform and/or these Terms of Service will result in civil and criminal liabilities

5. Peza Job reserves the rights to remove any of your material as we deem appropriate without any notice or requesting your consent. We will also look to you for any recourse.

Limitation of Liability

6. Peza Job is only a career hub and professional Job Search manager for job applicants, job posters and career coaching providers. We do not represent or guarantee that:

• Usage of our Platform and services will result in successful jobs, interviews or recruitment;
• Any advice provided by us, date, content or material available on the Platform or provided by Peza Job is accurate or useful;
• A job applicant is competent or truthful;
• A job post or job poster is genuine and legitimate;
• The Platform shall be fault free, error free, virus/bug free or uninterrupted.

7. The Platform may include links to third-party sites or material. Peza Job has no control over third-party sites or material and shall not be responsible as such.

8. In no event shall Peza Job be held responsible for any transaction between a job seeker and an employer or in any case, transactions between users of the Platform, and users with third parties.

9. Peza Job shall under no circumstance be liable for any of the following losses or damage, regardless of whether it is foreseen, foreseeable, known or otherwise:

• Loss of data (including Personal Data);
• Loss of revenue or anticipated profits;
• Loss of business and opportunity;
• Damage to goodwill or reputation;
• Losses by third parties; and
• Indirect, consequential, special or exemplary damages arising from use of Platform

10. In addition, Peza Job shall not be liable for any delay or failure in performance resulting in anyway from causes beyond our control, including without limitation, power failure, IT network, computer, server and infrastructure failure, fires, act of God, war, government actions and non-performance of third parties.

11. To the fullest extent permitted in law, Peza Job and its affiliates, associated companies, officers, directors, employees, agents, proprietors, partners, representatives, servants and advisors shall not be liable in any event for damage of any kind suffered by you whatsoever directly or indirectly arising from or relating to your use of or inability to use the platform.

Indemnity

12. You agree to indemnify, defend and hold harmless, Peza Job and its affiliates, associated companies, officers, directors, employees, agents, proprietors, partners, representatives, servants and advisors from and against any and all claims, actions, demands, injury, liability, losses, damages, costs and expenses (including legal expenses on an full indemnity basis) arising from or relating to your use and/or breach of the Platform or these Terms of Service. You further agree that this indemnity is separate and shall not prejudice our rights to any other rights or remedies in law.

Equal Opportunities

13. Peza Job is committed to equal opportunities and expects the employer to comply with all anti-discrimination legislation as regards the selection and treatment of Candidates.

Termination

14. Without limitation to any of our rights or remedies in law, Peza Job may, without notice and at our sole discretion, restrict, refuse application of, and terminate any user account, use of the Platform and our services.

Confidentiality

15. Any data and information provided by Peza job, including Personal Data as further governed by our Privacy Policy, shall be deemed confidential and you agree to hold it in the highest confidence and only use and disclose it in accordance with the permission and direction provided by us.

Subscription

16. The user will pay promptly the Subscription Fees as required by Peza Job from time to time, which the user may choose if it is monthly, 6 months or annually. The subscription fee is only charged for the purpose for using our platform and for the maintenance of the platform.

With this registration, you agree to accept communications (through Calls/Chat/ Mails/SMS) on the numbers made available during registration.

Profiles of the Day

17. Sponsored Profiles of Job seekers will appear at the top of the search results page where the employer search results query matches that of the job seeker. Where there is no set search query Pezjob will randomly recommend profiles.

18. In case you chose to discontinue your membership with us, you can unsubscribe / remove your account by completing the delisting procedure using the delete Account available in your account setting.
